Overcoming Visa Hurdles: A Plain-English Guide to Medical & Character Waivers for New Zealand

New Zealand Visa Waivers: Medical & Character Guide

Applying for a New Zealand visa can be stressful enough without worrying about past mistakes or a complicated medical history. If Immigration New Zealand (INZ) flags a criminal record, previous visa issues, or a health condition, it doesn’t automatically mean the end of your immigration dream. You might be eligible for a Character Waiver or a Medical Waiver.

These waivers can seem incredibly complex, but understanding them shouldn’t require a law degree. Here is a straightforward breakdown of how these waivers work, when they apply, and what you can do to strengthen your case.

At a Glance: Character vs. Medical Waivers

Feature Character Waiver Medical Waiver
Triggered By Criminal history, immigration violations, or providing false information. Failing to meet the Acceptable Standard of Health (ASH).
Can I Request It? Yes. You must provide a full explanation and explicitly request the waiver. No. INZ automatically decides whether to initiate a waiver assessment.
Availability Available across most visa types, depending on the severity of the circumstances. Broadly available for resident visas; strictly limited for temporary visas.

What is a Character Waiver?

To be granted a New Zealand visa, you must be of “good character.” This means INZ checks your background to ensure you aren’t a security risk or a threat to public order.

When do you need one?

You will typically need a character waiver if you have:

  • Criminal convictions: Especially those resulting in prison time, or offences involving violence, drugs, or recent dangerous driving (like a DUI).
  • Immigration violations: Such as being deported, removed, or excluded from any country, not just New Zealand.
  • Provided false or misleading information: If you withheld material details or submitted forged documents in a past or current visa application.

How does Immigration New Zealand decide?

A character waiver isn’t a guarantee; it is an exception. INZ will look at the “surrounding circumstances” to decide if they are compelling enough to grant your visa anyway. They weigh factors such as:

  • The seriousness of the issue: A minor traffic fine from a decade ago is treated very differently than a recent, serious conviction.
  • Time elapsed: How long it has been since the offence or incident occurred.
  • Your ties to New Zealand: Do you have immediate family living here lawfully and permanently?
  • Your potential contribution: Will your skills or employment significantly benefit New Zealand’s economy?
  • Your honesty: If the issue involves false information, was it an honest oversight, and did you provide a reasonable, credible explanation?

What is a Medical Waiver?

INZ requires most applicants to have an Acceptable Standard of Health (ASH). This rule exists to protect public health and ensure migrants don’t place heavy financial demands on New Zealand’s publicly funded health and special education services.

When do you need one?

If an INZ medical assessor determines that your health condition is likely to require hospitalisation, high-cost pharmaceuticals, or residential care, you will not meet the ASH requirements.

The Golden Rule of Medical Waivers:

You cannot apply for a medical waiver. Unlike a character waiver, you don’t tick a box on your application to request one. Instead, if you fail the health requirements, INZ will automatically decide whether they will consider you for a medical waiver based on the specific visa you are applying for.

Who is eligible for consideration?

  • Resident Visas: Many resident visa applicants are eligible to be considered for a waiver. However, absolute bars exist. You cannot get a medical waiver if you require full-time care, have active tuberculosis (TB), severe haemophilia, or require dialysis.
  • Temporary Visas: It is much harder to get a medical waiver for a temporary visa. They are generally only granted to partners or dependent children of NZ citizens/residents, recognized refugees, or seconded business people whose employers guarantee medical costs.

How does INZ decide?

If you are eligible for consideration, INZ will weigh the projected cost of your healthcare against the benefits you bring to New Zealand, heavily factoring in your skills, family ties, and intended length of stay.

Why You Shouldn’t Navigate Waivers Alone

Waivers are highly discretionary. Because an immigration officer makes a judgment call based on your unique circumstances, the quality of your explanation and the strength of the evidence you provide can make or break your application.

At Immigration Advisers New Zealand Ltd, we specialize in managing complex visa applications. We know exactly how to frame your situation, gather the right medical or character evidence, and advocate on your behalf directly with INZ.
